The Lokpal of India

The Lokpal is the first institution of its kind in independent India, established under the Lokpal and Lokayuktas Act 2013 to inquire and investigate into allegations of corruption against public functionaries who fall within the scope and ambit of the above Act.

The Lokpal of India is committed to address concerns and aspirations of the citizens of India for clean governance. It shall make all efforts within its jurisdiction to serve the public interest and shall endeavor to use the powers vested in it to eradicate corruption in public life.

India is a signatory to the United Nations Convention against Corruption. The commitment of the Government to provide clean and responsive governance is reflected in passing of the legislation and creation of the body of Lokpal, to contain and punish acts of corruption.

This is what the then Secretary General of United Nations has had to say on the adoption of the resolution by the Member States:

"Corruption is an insidious plague that has a wide range of corrosive effects on societies. It undermines democracy and the rule of law, leads to violations of human rights, distorts markets, erodes the quality of life and allows organized crime, terrorism and other threats to human security to flourish. This evil phenomenon is found in all countries – big and small, rich and poor – but it is in the developing world that its effects are most destructive. Corruption hurts the poor disproportionately by diverting funds intended for development, undermining a Government’s ability to provide basic services, feeding inequality and injustice and discouraging foreign aid and investment. Corruption is a key element in economic underperformance and a major obstacle to poverty alleviation and development."

Logo and Motto/Slogan

Lokpal is a statutory body constituted under The Lokpal and Lokayuktas Act 2013 to enquire into allegations of corruption against certain categories of public servants/ functionaries and for connected/incidental matters. The Lokpal provides a mechanism for prompt and fair investigation and prosecution in cases of alleged corruption.

Lokpal invites entries from public (individuals/ organizations) for a Logo and Motto/Slogan statement. Interested parties may submit their designs for either logo or Motto/Slogan or both by 13th June, 2019. The design offered must be original and should not violate any provision of the Indian Copyright Act, 1957.

The accepted entry will be used as logo and/or Motto/Slogan of Lokpal in stationary, backdrop, for IEC and any other way that the Lokpal deems fit.

Technical Parameters for Logo:

  • The participant should send the logo as an attachment file in JPG or PNG format
  • The winner of each competition shall be required to submit the design in an editable and open file format.
  • The prize money for the winning Logo will be INR 25,000.
  • Designs submitted should not have imprint or watermark.
  • Logo should preferably be designed in colours but should not have more than 2-3 colours.
Technical Parameters for Motto/Slogan
  • The participant should send the Motto/Slogan as an attachment file in PDF format
  • The Motto/Slogan should be catchy and should not be more than 4-5 words.
  • The prize money for the winning Motto/Slogan will be INR 25,000.
  • The language for the Motto/Slogan could be Hindi/Sanskrit/English
Evaluation Criteria
The competition is open to all Indian citizens/ institutions residing within and outside India.

All entries received within the due date will be evaluated by a Selection Committee constituted by the Lokpal. The decision of the Selection Committee will be final and binding on all the participants.

Entries will be judged and selected based on creativity, simplicity, artistic merit, and visual impact and how well they communicate the concept of Lokpal.

The Logo and Motto/Slogan design of the successful entry will be duly acknowledged in an appropriate way by the Lokpal. However, selected entries will be the intellectual property of the Lokpal and the designer will not have any right over it.

Jurisdiction and Functions of Lokpal

The Lokpal has jurisdiction to inquire into allegations of corruption against anyone who is or has been Prime Minister, or a Minister in the Union government, or a Member of Parliament, as well as officials of the Union Government under Groups A, B, C and D. Also covered are chairpersons, members, officers, and directors of any board, corporation, society, trust, or autonomous body either established by an Act of Parliament or wholly or partly funded by the Union or State government. It also covers any society or trust or body that receives foreign contribution above ₹10 lakh (approx. US$ 14,300/- as of 2019).

A complaint under the Lokpal Act should be in the prescribed form and must pertain to an offence under the Prevention of Corruption Act, 1988 against a public servant. There is no restriction on who can make such a complaint. When a complaint is received, the Lokpal may order a preliminary inquiry by its Inquiry Wing or any other agency, or refer it for investigation by any agency, including the CBI, if there is a prima facie case. Before ordering an investigation by an agency, the Lokpal shall call for an explanation from the public servant to determine whether a prima facie case exists. This provision, the Act says, will not interfere with any search and seizure that may be undertaken by the investigating agency. The Lokpal, with respect to Central government servants, shall refer the complaints to the Central Vigilance Commission (CVC). The CVC will send a report to the Lokpal regarding officials falling under Groups A and B; and proceed as per the CVC Act against those in Groups C and D.

The Inquiry Wing or any other agency will have to complete its preliminary inquiry and submit a report to the Lokpal within 60 days. It has to seek comments from both the public servant and "the competent authority", before submitting its report. There will be a "competent authority" for each category of public servant as defined under the Act.

A Lokpal Bench shall consider the preliminary inquiry report, and after giving an opportunity to the public servant accused of corruption for his/her defence, decide whether it should proceed with the investigation. It can order a full investigation, or direct to start departmental proceedings or close the proceedings. It may also proceed against the complainant if the allegation is false. The preliminary inquiry should normally be completed within 90 days of receipt of the complaint.

After the investigation, the agency ordered to conduct the probe has to file its investigation report in the court of appropriate jurisdiction, and a copy of the report has to be filed before the Lokpal. A Bench of at least three members will consider the report and may grant sanction to the Prosecution Wing to proceed against the public servant based on the agency’s charge-sheet. It may also ask the competent authority to take departmental action or direct the closure of the report. Previously, the authority vested with the power to appoint or dismiss a public servant was the one to grant sanction under Section 197 of the Code of Criminal Procedure and Section 19 of the Prevention of Corruption Act. Now this power will be exercised by the Lokpal.

The Lokpal is vested with the power of search and seizure and also powers under the Civil Procedure Code for the purpose of conducting preliminary inquiry & investigation and power of attachment of assets and taking other steps for eradication of corruption.

Lokpal will have power of superintendence and direction over any central investigation agency including CBI for cases referred to them by the Lokpal.

Organization Structure

A detailed organogram giving the details of the organizational structure of the Lokpal is under preparation. The Lokpal consists of a Chairperson and eight Members out of whom 50% are Judicial Members. The Chairperson and the Members are appointed by the President of India by warrant under his hand and seal and hold office for a term of five years from the date on which they enter upon the office or until they attain the age of 70 years, whichever is earlier. The salary, allowances and other conditions of services of the Chairperson are the same as that of Chief Justice of India. The salary, allowances and other conditions of services of the Members are the same as that of a Judge of the Supreme Court.

Lokpal will have two main branches and will discharge its functions through these two.

  1. The Administrative branch will be headed by an officer of the rank of Secretary to Govt of India and will have in its fold:
    1. Inquiry/ Investigation branch to be headed by an officer not below the rank of Additional Secretary to Govt of India
    2. Prosecution wing to be headed by an officer not below the rank Additional Secretary to Govt of India
    3. Central Registry
    4. Scrutiny wing
    5. Establishment, Coordination, Media and Publication
    6. Budget, Finances and Accounts
  2. The Judicial Branch will be headed by a Judicial officer of appropriate level and will assist the Lokpal discharge their judicial functions.

Both these branches will be appropriately staffed.

All the administrative and judicial functions will be facilitated through a work flow application. The complainant as well as other concerned parties will be informed of the status of their respective cases by way of text messages on cell phones (sms) as well as e-mails (if email id is known). The complaint shall be filed in the prescribed form to be notified.
